EUROPEAN ARREST WARRANT

The European Arrest Warrant is legislation implemented by the European Union which allows European judges to order the arrest of any European citizen and have them extradited to stand trial in the country where the alleged offence occurred.
“Jack Straw, Charles Clarke, Jacqui Smith and Alan Johnson — who between them set UK security policy for almost a decade — said leaving would pose a “serious risk”.They highlighted the EU’s role in sharing information across member states, implementing tougher controls at airports and enforcing the European Arrest Warrant (EAW).” (1)
THE CASE FOR A #FREEBRITAIN
"The European Arrest Warrant leads to the extradition of British Nationals based on a standard of suspicion or proof which in some cases would fall short of the standards required in British justice. Critics have stated that is has a wide range of flaws with cases to prove it causes injustice. For instance in the case of Andrew Symeou, a British student extradited to Greece in 2009: “Serious doubts emerged about the reliability of the evidence against Symeou and he was ultimately acquitted of manslaughter, but not spending 10 months in appalling prison conditions away from his friends and family. The case against him was ultimately flawed, but our courts were powerless to prevent the extradition” (2)
Also, another case where by the European arrest warrant whereby there was a grave miscarriage of injustice was the case of Ashya King. "A European arrest warrant has been issued for the parents of a five-year-old boy with a brain tumour, missing from hospital since Thursday. Ashya King was taken out of Southampton General Hospital by his mother and father against medical advice."(3)
The European Arrest Warrant should not have been issued in this incident, the family did not commit a crime but instead were seeking the best medical care for their child in which the NHS could not provide. The EAW does not need to be enforced. We do not need this legislation from the EU, we can implement our own laws to protect the people of the U.K. We can also arrange our own extradition treaties and allow people to have an extradition hearing in a U.K. court before requiring them to face trial abroad."
